In 2002, the State legislature enacted SB 800 which added Title 7 (Sections 895-945.5), Part 2, Division 2, to the California Civil Code. This legislation is commonly known as the “Right to Repair Law”, and was adopted to help facilitate home repairs caused by defects.
S&S Homes of the Central Coast Inc. (the “Builder”) intends to comply with all of the builder’s obligations under the Right to Repair Law (“Law”). The original seller (“Seller”) of any new homes constructed by the Builder also intends to comply with its obligations under said Law.
The undersigned Homeowner(s) acknowledge and agree that:
1. The Homeowner(s), Seller and Builder are obliged to follow the pre-arbitration/litigation procedures set forth in California Civil Code Sections 910 through 938 of the Law (hereafter, the “Statutory Procedures”).
2. Neither the Homeowner(s), Seller or Builder have agreed to be bound by any contractual provisions as an alternative to the procedures set forth in Civil Code sections 910 through 938. Neither the Builder nor the Seller have elected to use any such alternative contractual provisions, and no alternative provisions were attached to the original purchase agreement by which the Seller sold your home to the original buyer.
